Agreement
These Terms form a binding agreement between you and Velari Aviation Technology (“Velari”). If you are using Velari on behalf of an organization (an operator or fleet), you represent that you have authority to bind that organization to these Terms.
Eligibility
You must be at least 18 years old and located in the United States. Crew accounts require a valid U.S.-issued FAA airman certificate. Operator accounts require evidence of a U.S. Part 91 operation. Velari may suspend or terminate any account that does not meet these requirements.
Accounts
You are responsible for maintaining the confidentiality of your credentials and for all activity that occurs under your account. Notify us immediately at legal@velarigroup.ai of any unauthorized use.
The platform
Velari is a two-sided marketplace that helps Part 91 operators plan trips and contract pilots/flight attendants apply to them. Velari is not a charter broker: we do not sell passenger seats, do not arrange charters, and do not touch trip revenue.
Velari is the platform layer; the contractual engagement for any specific trip is between the operator and the crew member who is hired. Velari is not the employer of any crew member nor a party to the operator/crew engagement contract.
Engagements & payments
When an operator hires a crew member through Velari, the engagement is governed by the day rate and terms posted in-app and any additional written agreement between the parties. After the trip closes and approved expenses are reconciled, Velari issues a single Net-30 invoice covering crew pay, approved expenses, and Velari’s placement fee.
Velari does not charge cards in-app. Operators pay invoices via the methods we publish in the CRM. Late payments accrue interest at the lower of 1.5% per month or the maximum rate permitted by law.
Acceptable use
You agree not to:
- Misrepresent your identity, credentials, ratings, currency, or operator certificate.
- Use Velari to broker passenger seats or to circumvent the U.S. Part 91 / Part 135 distinction.
- Solicit users off-platform to avoid Velari’s placement fee for an engagement initiated on Velari.
- Scrape, reverse-engineer, or interfere with the operation of the platform.
- Upload malicious code, infringing content, or content that violates law.
User content
You retain ownership of content you upload (certificates, profile data, messages). You grant Velari a limited, non-exclusive license to host, process, and display that content as needed to operate the service. You are responsible for the accuracy of any credential or trip information you submit.
Intellectual property
The Velari brand, software, designs, and documentation are owned by Velari and protected by copyright, trademark, and other laws. These Terms grant you no rights to that intellectual property beyond using the service as intended.
Third-party services
Velari integrates third-party services (cloud hosting, KYC, document scanning, payment processing). Their terms and privacy practices apply to your use of those services as part of Velari. We choose providers carefully but do not control their independent acts.
Disclaimer
Velari is provided “as is” and “as available.” To the maximum extent permitted by law, Velari disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Velari does not warrant that any specific crew or operator on the platform meets any third-party standard beyond the verifications we publish.
Limitation of liability
To the maximum extent permitted by law, Velari’s total liability for any claim arising out of or related to these Terms or the service is limited to the greater of (a) the placement fees paid by you to Velari in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100). Velari is not liable for indirect, incidental, special, consequential, or punitive damages.
Indemnification
You agree to defend, indemnify, and hold harmless Velari from any claim arising out of (a) your breach of these Terms, (b) your violation of law, or (c) any engagement you enter into with another user on Velari.
Termination
You may close your account at any time from the app. Velari may suspend or terminate your access if you violate these Terms, misrepresent your eligibility, or pose a risk to other users. Provisions intended to survive termination (payment, IP, disclaimers, liability, indemnity, governing law) survive.
Governing law
These Terms are governed by the laws of the State of New York, without regard to conflict-of-law principles. The exclusive venue for any dispute is the state and federal courts located in New York County, New York. Each party waives any right to a jury trial.
Changes
We may update these Terms as the product or the law evolves. Material changes will be announced in-app and by email at least 30 days before they take effect.
